There are some shitty articles out there, with shitty headlines, trying to cause fear and anger over a very serious policy that exists for safety reasons.  My biggest issue with this has been, and continues to be, is the guy behind this suit was wrongfully arrested.  THIS is a much bigger deal.  Inmates right to privacy? Not so much.<br /><br />If anyone needs to ask questions about this kind of thing, to someone who knows a little something about the subject, feel free to ask. ]]>

If you're in jail, the police have presumably executed a proper arrest warrant against you and have satisfied due process that they can detain you against your will.  So you have, through due process, had some of your normal rights as a citizen (ie, freedom of movement) reduced or removed temporarily.  It seems only reasonable that your expectation of privacy will also be reduced, up to and including strip searches. ]]>

If god forbid, I or anyone I knew were locked up behind bars for any amount of time, I'd like to know the officers did everything in their power to remove the chance of the other people locked up having weapons. We know inmates can make their own knives, etc, but I think it's useful knowing that they're not bringing in large amounts of drugs, or even (as recently we've seen) <a href="http://www.huffingtonpost.com/2012/01/16/man-hides-gun-in-rectum_n_1208666.html" >putting a gun up their ass</a>. That guy was arrested on a minor traffic infraction. <br /><br />People are saying that some offenses are so minor that they shouldn't require being strip searched. That's like telling people we're going to be giving certain inmates free passes to bring in shit. Unless somehow you're keeping those people locked up in a different area, maybe I could see that; like the drunk tank. But since drunks are at a high risk of suicide in jail, that might not be a good idea. <br /><br />Also, some people are mules, and deliberately get arrested to smuggle things into county. This helps fight that. Arrest, and being held without bail means a reduction in rights. You are not free to go, being the most obvious. The right to privacy is non-existent in jail. Obviously, bad cops abuse laws and need to be held accountable. Goes without saying, or at least it should be. But laws like this are in place for one reason: to protect the inmates and staff in the prison. If it makes people uncomfortable, shucks guys, I'm sorry. But it helps people not get stabbed as much, and I'm always going to be in favor of people being stabbed less often. ]]>

			<![CDATA[ @GovSpy, you and I have completely different perspectives on this, and that's totally fine. <em >I DO agree with you on the prison thing.</em> It's of the utmost importance to me that the US Prison system (which is its own kind of interesting and unique and special) remains as safe as possible. <br /><br />I just take issue with being able to order strip searches on any minor arrest because I frankly don't have all that much faith in the abilities of our police officers to not abuse the power. And maybe that's just me being incredibly pessimistic, but I think that's fine. Just two different world-views is all. ]]>

			<![CDATA[ Hm, could be that quite a bit of the sound and fury over this comes from the startling frequency of mass arrests at Occupy protests and the almost biweekly emergence now of some sort of police brutality/mishandling scandal. I actually don't disagree with anything GovSpy says* <em >in the abstract</em>, but when you consider this decision in light of the other recent events it gets a whole lot scarier.<br /><br />Of course, maybe the solution isn't to be up in arms about this decision but to be up in arms about the other ways in which the police in a lot of areas seem to be systematically failing the whole serve and protect/don't abuse power/&c. thing. Or, perhaps targeting the politicians who keep writing laws that encourage and often demand what we see as abuse of power. The Supreme Court is an easy target for anger here, but I'm not sure that makes them the best one, and I say that as someone uncomfortable with the ruling myself.<br /><br /><br />*In part because, well, this is his field, and I'm just an art historian. The hell do I know? ]]>

			<![CDATA[ @dorkmuffin & keeper<br /><br />I definitely respect your guys' opinions, and I understand why you guys feel the way you do.  Pre-the job, I thought somewhere along those lines.  But safety in jail (and I mean jail, not prison) is a tricky thing.  Basically, you'd have to keep these minor offense guys completely seperate from everyone else.  And depending on the ciy/county you're at, that may not be feasable.  The original guy in this story, when he's booked in initially, that it may have been possible to keep him seperate, and the first search may have been avoidable.  Later, when he's transfered into another facility, and put in general population, sorry buddy, you're gonna get searched.  <br /><br />Too many times, though, there have been instances where people who've comitted minor offenses and were locked up for just a day or two, were found with drugs or weapons, or later were found to have gang tattoos making them targets for gang violence when the tank they're housed in is populated with a majority of a rival gang.  Had a proper search been done, the inmate's gang affiliation would have been documented properly, and any dangerous repurcussions would have been avoided to the best of the staff's ability.<br /><br />See here's the deal.  Jail guards deal with the day-to-day operations.  We don't get to decide when or how things are implemented; we just implement them.  When someone is injured (for instance, in an assault) we like to be able to say "I did everything possible to prevent this situation from happening."  If we don't properly search people during intake, we can't say that.  <br /><br />When policies are passed regarding the duties of law enforcement officers, questions are always raised about if officers abuse the rules and regulations, or the acts of corrupt officers.  These questions deserve their own scrutiny, not solely with conjunction to the most recent law being passed.  <br /><br />For the example of the man where this suit was originated, I feel that more emphasis needs to be on how this man was wrongully arrested when he had paid his fines, and had proof.    It's like having several related arguements at the same time.  They are all valid arguements, and worth having, but you cannot solve one issue by bringing up a different issue.  Why do all people in jail intake need to be searched?  Why do some officers get away with abusing people in custody?  Why are some agencies showing warrants out for people, and others show the charges were dropped (etc.)<br /><br />in general, the prison and jail systems are reactionary.  We try to keep up with the inmate population's tactics.  Just about every rule & policy is there because of an event that happened, and the new rule is implemented to prevent the same mistake from being allowed to happen again.  When asked, "Did this happen before?" we like to say, "Yes, but this is how we changed things to prevent it, and this is how we'll adapt for the future."<br /><br />(Edited to add : Sorry, I'm long winded) ]]>

I'm just interested in the question of where the strong reaction from the public is coming from, and how the anger might be justified even though the target--this particular ruling and the Supreme Court--maybe is not.<br /><br />At the very least, I think this would be much less of an issue if people felt like there was little to no chance of them getting arrested. But these days it honestly does feel like it could just take one slip up for a person to get hauled off to jail. Like you say, though, that's less a problem with procedures once someone is arrested and more a problem with the greater and greater fear of arrest for wrongful reasons. ]]>

			<![CDATA[ <strong >Regarding the Rhetorical fallacy chart</strong>:<br /><br />Need to remind everyone that just because an argument is based on a rhetorical fallacy, doesn't mean that it's wrong - it's shortcuts. Sometimes those shortcuts aren't fair, but it's very much up to interpretation. For example, the Reductio Ad Absurdum: When you ridicule an oponent's argument, how far  is too far? "Faith in God is like believing in Santa Claus and the Tooth Fairy". How is that an unfair claim? It's hard to see how the concept of god differs from the other two. The only defenses, I could see, is either A. that the existence of god is empirically proven, or B. you use one of the other logical fallacies like an appeal to tradition or popular belief or unfalsifibility. <br />I love rhetorics and argumentation theory, but it's pretty easy to shut down someone's argument by pointing out that they're using logical fallacies. Even if they're correct. <br /><br />The chart itself is a nice shortcut, but like the logical fallacies it's shortcuts, and their veracity is questionable. ]]>

I've been taking paracetamol my entire life and my liver is fine, because I take the time to read the instructions and not exceed the correct dosage. The same goes for ibuprofen - which can pretty much dissolve your stomach lining if used inappropriately - and codeine - which can be highly addictive.<br /><br />The naturalistic fallacy really pisses me off. Any time I hear someone carry on about how their plant based medicines can't possibly hurt them because they're 'natural' I want to hand them a bunch of atropa belladonna roots to chew on. ]]>

			<![CDATA[ I recently tried to point out to someone that all types of energy generation have environmental downsides. The Rare Earth elements used in wind turbines can be highly toxic. Silicon foundries used ot make soalr cells can be highly pollutign and one type of celsl that's growing in popularity uses Cadmium Telluride - and both Cadmium and Tellurium are also highly toxic.<br /><br />His response: "Well at least they don't stay deadly for hundreds of thousands of years."<br /><br />No, they stay deadly for billions of years.<br /><br />(Disclaimer: I am not saying solar power is as dangerous as nuclear . I'm saying ALL forms of power generation have downsides that need to be considered. ]]>

Reap the fucking whirlwind.<br /><br />To me, the killer line in that article is: "refining rare earths into metals, alloys and end products such as magnets -- haven't been done in the United States since the early 2000s." 			<![CDATA[ I'm probably better off keeping my mouth shut w/r/t medicine but I completely agree with above comments about homeopathy and vaccination. I'm an acupuncturist and a Chinese herbalist and the people who come to see me are frequently disappointed to hear that I'm a rational empiricist and not inclined to agree with their "misguided" beliefs. These people are super irritating...I know because I had to spend 3500 hours of grad school listening to them nattering on about all kinds of soft-headed nonsense. Recently I've realised that actually I don't really know what I'm talking about.  <br /><br />As a P.S. I wasn't vaccinated as a child as a result of my parents (at the time) being Christian Scientists.  As a result I contracted (they think) mumps as a baby and lost the hearing in my right ear.
