Does anyone know of any cases where a "Click here to confirm you're 18 and totally not just lying" age-verification system has gotten to court? I'm really curious how well that sort of thing holds up.

I mean, obviously it's not going to stop any kid anywhere from looking at adult material, but complaining about that is missing the point. It's not really supposed to prevent access, it's supposed to shift blame. If they have the warning and age-click, then they can say "Well, we didn't host adult content for kids, your kid lied about his age to get in. He's the one who broke the rules." Which could just work. But then, IANAL, which is why I'm curious if this has ever been legally tested. Is it enough to have a rule without effective enforcement? It's not as if there's anything they really can do to check people's ages, and I honestly don't blame them for being worried about being sued by some irate parent.

I do realise this may be veering slightly off topic.

turing
Does anyone know of any cases where a "Click here to confirm you're 18 and totally not just lying" age-verification system has gotten to court? I'm really curious how well that sort of thing holds up.

I had an experience with something like this where my younger brother, he is 16, complained that there was some type of virus on his computer. The problem was, whenever the machine was on there was an IE window that stayed on top and restarted when closed, that was demanding a payment of ~£30, this was from some porn website where when you login you say you are over 18 the site downloads, what is essentially a trojan, onto the computer, and you must pay before they will remove it. Now this was done by one of my brothers friends, and I know this because my brother is registered blind and he uses a voice synth to use his computer. When I phoned up the company they just demanded payment, yea right! I then phoned up trading standards and apparently what they are doing is legal, they have a right to demand payment from the owner of the computer to remove this piece of malware that could have been installed by anyone, essentially it is the computers owner who owes the company money. When I explained the full situation to the girl at TS she told me I could probably get the trojan removed and the payment waived if I explained the situation to the company!! I assume that if this is essentially entering into some type of contract that an under-ager could be charged with fraud if he fills in the details incorrectly.

Possible fix for you Warren (and other sufferers), if you've not already done this:

"As a default setting, they have EVERY SINGLE JOURNAL set to filter out the "adult content" setting! So if your friends try to do the right thing and mark their porny LJ's appropriately, you CAN'T SEE THEM until you change your viewing settings. Which is kind of hard to figure out how to, even if you know you have to in the first place.

Go to your User Options page, and click on Journal - settings. The Viewing Options page will appear, and all the way at the bottom is a section called "AdultContent Options". Your "Safe Search Options" has been set to "use moderate filtering - filters explicit and adult content".

So if someone on your F-list has recently dropped off the map and you have no idea why, try going here and changing your settings. Otherwise, if their LJ is set to "adult" you won't be able to see any of their public entries on your friends page."

This is, to put it mildly, not widely mentioned by 6A posts on the subject... after doing this (and making sure my full date of birth year is in my user details) all my pr0n and other growed-up stuff is running fine.

"It reset itself to Moderate and Collapse Adult Content 24 hrs later."

I'm also running Adblock and having no troubles from the 6A retrofit. A pattern emerges?

Alternative technique suggested by LJ user marchenland:

"1. Edit your profile: http://www.livejournal.com/manage/profile/?style=mine
2. Set your birth year to something more than 18 years ago
Note: If you're not comfortable with people seeing your age, set Show Your Birthday to Nobody.
3. Click the Save Changes button at the bottom of the page.
4. Edit your Viewing Options: http://www.livejournal.com/manage/settings/?style=mine
5. Scroll down to the Adult Content section.
6. Set your Adult Content level for your journal.
Note: Most adults' LJs contain Adult Concepts (taxes, death, etc.) but I don't think LJ is talking about those things. Use your discretion.
7. Set Viewing Adult Content to Do Not Collapse.
8. Set Safe Search Filtering to Do Not Filter My Results.
9. Click the Save Changes button at the bottom of the page.
10. All done. Never think of it again."

Best of luck, all.

 @Cat Vincent:

Thanks for the info on InsaneJournal. Maybe it is time to get committed. . . . This latest stupidity has me ready to move on, but I don't want to abandon friends on LJ. Even the ones who seem nonplussed by this ridiculous new electronic barrier.

And to Mr. Ellis:

Thanks for provoking my curiosity by showing "scans_daily" on that LJ shot. I decided to check it out based on the post about Captain Carrot, and now I'm wasting even more of my time online laughing at the adventures of a bare-bottomed Tarot and wondering how I missed all that innuendo in the Justice League. . . . I just can't look away. . . .
